Applications related to the new Cottage Food Program may be submitted at any time through the program’s registration webpage. These applications are now being reviewed, processed, and approved subject to applicants meeting all statutory requirements set in place by HB2042.

HB 2042 directs ADHS to develop rules, and we are committed to working with stakeholders to implement the law with fidelity. The new rules will be applicable to Cottage Food producers once they're finalized. We encourage new and existing Cottage Food registrants and future entrepreneurs to monitor our rulemaking webpage for draft rules to participate in that rulemaking process. We look forward to supporting participation in this enhanced program.

Arizona’s Cottage Food Program allows individuals to make homemade products that are neither potentially hazardous nor Time or Temperature Control for Safety (TCS) Foods, and offer them for commercial sale.

In 2011, the Arizona State Legislature changed the law—A.R.S. 36-136 (H)(4)(g) and A.R.S. 36-136 (H)(13)—to allow residents to produce non-potentially hazardous baked and confectionery products in their homes and offer them for commercial sale within the state. This law was amended in 2018. The topics listed above provide general guidance for this law, as well as required food handler training and labeling requirements. The rules of this program are found in Arizona Administrative Code R-9-8-118.
