Emergency Medical Services Phase 1 Rulemaking (Exempt)
The statutes in Arizona Revised Statutes (A.R.S.) Title 36, Chapter 21.1, govern emergency medical services. The Department uses the authority granted by these statutes to make the rules in Arizona Administrative Code (A.A.C.) Title 9, Chapter 25. Laws 2012, Chapter 94 makes many changes to the statutes in A.R.S. Title 36, Chapter 21.1, which will require the Department to amend 9 A.A.C. 25. To facilitate these changes, Laws 2012, Chapter 94, § 29, gives the Department exempt rulemaking authority until December 31, 2013 to implement the changes made to statutes.
One of the changes made by Laws 2012, Chapter 94 is to make the classification of individuals certified by the Department to provide emergency medical services, now to be known as "emergency medical care technicians," consistent with national classification levels. This will require amending the rules in 9 A.A.C. 25 to not only use the new classification terminology, but also to establish the scope of practice, training requirements, and certification/recertification requirements for each level of emergency medical care technician. Due to the extent of changes that need to be made, the Department is conducting this exempt rulemaking in phases.
The first phase of the rulemaking focuses on making changes that most affect individuals who are currently certified by the Department and their employers. The Department will be establishing in rule: the scope of practice in A.A.C. R9-25-502; training requirements in 9 A.A.C. 25, Article 3; and recertification requirements in A.A.C. R9-25-406 for each level of emergency medical care technician. The Department has drafted revisions of 9 A.A.C. 25, Article 3, R9-25-406, and R9-25-502 and accepted public comment on the proposed revisions through an online survey until December 30, 2012.
The Notice of Exempt Rulemaking published in the Arizona Administrative Register on February 22, 2013, has errors in Table 5.1. A corrected Notice of Exempt Rulemaking was published on March 22, 2013. The effective date of the new rules remained January 28, 2013.
