When voters passed Proposition 203 in 2010, ADHS had 120 days to create a new program from scratch. The goal was to create the first truly medical marijuana program in the country. Staff from across the Department joined together to create a plan. The colossal undertaking included Information Technology systems for applications, reporting, and validating; staff combed through the rules in other states to help write the Arizona rules for how the program would work, how people could apply for the different types of licenses, when they could apply, how to add new debilitating diseases, among other things. Even though the initiative allowed the Department to avoid the normal rulemaking process, staff asked twice for written public comment and held four public hearings to gather public opinion.

On January 31, 2011, the Department posted the medical marijuana draft rules
for public comment period and received the following comments via online survey during the comment period from January 31 to February 18, 2011:
- Question 1: What parts of the draft rules do you believe are effective?

- Question 2: How can the draft rules be improved?

- Question 3: Do you have any specific language to improve the rules?

- Question 4: Has anything been left out that should be in the rules?
