On April 13, 2011, Governor Brewer signed HB2634 (Laws 2011, Chapter 96), which requires the Department to revise rules to reduce monetary or regulatory costs on persons or individuals, streamline the regulation process, and facilitate licensure of integrated health programs that provide both behavioral and physical health services. As part of this project, the Department is revising Arizona Administrative Code (A.A.C.) R9-1-412 to update the incorporated physical plant health and safety codes and standards. This rule was last revised in 2006, so many of the physical plant health and safety codes and standards are out-of-date and in conflict with local health and safety codes and standards that persons must follow when building or modifying a health care institution. The Department is also removing some of the physical plant health and safety codes and standards that are in the current rule.
The Department has completed a draft of the revised rule and has solicited and received comments from the public about the draft rule. Only one comment was received. To ensure that the public has notice of the opportunity for reviewing and commenting on the new draft rules, the Department has submitted a Notice of Public Information (page 547) for publication in the April 5, 2013, issue of the Arizona Administrative Register. An online survey has also been provided and will be active until May 5, 2013.
The Department will continue to collect comments about the rulemaking process through another online survey.
